Welcome to MizCommerce. The terms "we", "us" and "our" refer to MizCommerce, which operates this store and website (the "Services") and is powered by Shopify. These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use the Services.
1. Access and Account
You represent that you are at least the age of majority in your state or province of residence. To use the Services you may be asked to provide certain information; you represent that all information you provide is correct, current and complete. You are solely responsible for the security of your account credentials and all account activity, and you may not transfer, sell, assign, or license your account.
2. Our Products
We have made every effort to accurately represent our products, but colors or appearance may differ on your screen. We do not warrant that products will meet your expectations or match how they are depicted. All product descriptions are subject to change at any time, and we may discontinue products or limit quantities at our discretion.
3. Orders
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason. Your order is not accepted until we confirm acceptance, and we must receive payment before acceptance. Purchases are subject to our Refund Policy. You represent that your purchases are for personal or household use and not for commercial resale or export.
4. Prices and Billing
Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed. Posted prices do not include taxes, shipping, handling, or customs charges unless stated. You agree to provide current, complete and accurate purchase, payment and account information, and you represent that you are authorized to use your payment method.
5. Shipping and Delivery
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. Once we transfer products to the carrier, title and risk of loss pass to you.

Our Services, including all trademarks, text, images, graphics, video and audio, and their selection and arrangement, are owned by MizCommerce, its affiliates or licensors and protected by intellectual property laws. These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, or republish any material without our prior written consent.
7. Optional Tools
You may be provided access to third-party tools we neither monitor nor control, provided "as is" and "as available" without warranties. Any use is at your own risk. New features added in the future are also subject to these Terms.
8. Third-Party Links
The Services may contain links to third-party websites we do not control. We are not responsible for the content or accuracy of third-party materials, and we are not liable for any harm related to your access of third-party sites. Review their policies before transacting.
9. Relationship with Shopify
MizCommerce is powered by Shopify, but any sales and purchases you make are made directly with MizCommerce. Shopify is not responsible for any aspect of sales between you and MizCommerce, and you release Shopify and its affiliates from claims arising from your purchases and transactions with us.
10. Privacy Policy
All personal information we collect is subject to our Privacy Policy, and certain information may be subject to Shopify's Privacy Policy. By using the Services, you acknowledge you have read these policies.
11. Feedback
If you submit any ideas, suggestions, feedback, reviews or proposals ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display it for any purpose, including commercial use. You represent that you own or have rights to all Feedback and that it will not violate any third-party rights or these Terms.
12. Errors, Inaccuracies and Omissions
Occasionally information in the Services may contain typographical errors, inaccuracies or omissions related to descriptions, pricing, promotions, shipping or availability. We reserve the right to correct errors and to change or update information or cancel orders without prior notice, including after you submit an order.
13. Prohibited Uses
You may use the Services for lawful purposes only. You may not use the Services for any unlawful purpose, to violate laws, infringe intellectual property, harass others, transmit malicious code, scrape or extract data via automated means, collect others' personal information, or interfere with the security of the Services. We may suspend or terminate your account if you violate these Terms.

If you use or deploy an Agent (software taking autonomous or semi-autonomous action) to interact with the Services, the Agent must identify itself in all requests (e.g. "Agent/[agent name]" in the user agent string), must not conceal that it is an Agent or circumvent CAPTCHAs and similar measures, must respond truthfully when asked whether interactions are from a human, and must not circumvent measures controlling Agent access. We may limit, including by technical measures, how any Agent accesses the Services.
15. Termination
We may terminate this agreement or your access to the Services at any time without notice, and you will remain liable for amounts due up to the date of termination. Provisions that by their nature should survive termination will continue to apply.

Information on the Services is provided for general information only; we do not warrant its accuracy, completeness or usefulness. The Services and all products are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Services will be uninterrupted, secure, or error-free.
17. Limitation of Liability
To the fullest extent provided by law, in no case shall MizCommerce, its partners, or those of Shopify be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the Services or any products procured using the Services.
18. Indemnification
You agree to indemnify, defend and hold harmless MizCommerce, Shopify, and our affiliates and partners from any losses, damages, liabilities or claims, including reasonable attorneys' fees, arising out of your breach of these Terms, your violation of any law or the rights of a third party, or your use of the Services.
19. Severability
If any provision of these Terms is determined to be unlawful, void or unenforceable, it shall be enforceable to the fullest extent permitted by law and the unenforceable portion severed, without affecting the validity of the remaining provisions.
20. Waiver; Entire Agreement
Our failure to exercise or enforce any right or provision is not a waiver of it. These Terms and any policies posted by us constitute the entire agreement between you and us and supersede any prior agreements.
21. Assignment
You may not delegate, transfer or assign these Terms or your rights or obligations without our prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.
22. Governing Law
These Terms shall be governed by and construed in accordance with the federal and state or territorial courts in the jurisdiction where MizCommerce is headquartered, and you consent to venue and personal jurisdiction in such courts.

You can review the most current version of these Terms at any time on this page. We reserve the right to update or replace any part of these Terms by posting changes to our website, and your continued use of the Services constitutes acceptance of those changes.
